S30 Studio Terms and Conditions
1. Definitions
1.1 The following terms apply in this Agreement:
Studio: Refers to the S30 Studio franchise gym premises where you applied for your membership. This includes all physical locations managed under the S30 Studio brand and operated under a franchise agreement.
Cancellation: Refers to a Member providing written notice to their Studio of their intention to cancel their membership. Written notice must be delivered via email or letter and will not be accepted through social media platforms or verbal communication. The Member must provide sufficient details, including their membership number and reason for cancellation.
Stripe: The third-party billing system used by S30 Studio for securely processing all recurring Direct Debit membership payments. Members agree to comply with Stripe's payment terms as part of this Agreement.
Direct Debit: Authorised recurring payment of membership fees processed through Stripe. Payments are deducted on the agreed schedule outlined in the Membership Agreement.
Early Termination: Refers to the cancellation of membership within the Minimum Term agreed upon at the time of sign-up. Early termination is only granted in exceptional circumstances, such as relocation or medical incapacity.
Early Termination Fee: Means 50% of the remaining instalments due from the date of termination to the expiry of the Minimum Term or another fee structure as specified in clause 4.4.
Facilities: Refers to amenities available at the Home Studio, including but not limited to bathrooms, changing rooms, showers, saunas, ice baths, and fitness equipment. Facilities may vary between Studios and are subject to availability and operational hours.
S30 Studio: Refers to the franchisee operating a Studio under a franchise agreement with S30 Studio New Zealand, S30 Studio Australia, or S30 Studio Singapore. This includes all agents, representatives, officers, directors, shareholders, affiliates, subsidiaries, and employees associated with the Studio.
OG Member: A Member who holds a Foundation Membership, which is a membership type offered during the initial launch phase of a Studio.
Foundation Membership: A pre-opening membership option with reduced instalments applicable only at the Member’s original Home Studio. Members who transfer this membership to another Studio lose the benefits associated with the Foundation Membership.
Home Studio: The Studio where the Member initially joins and which serves as their primary Studio for accessing facilities and services.
Member: A person who enters into a Membership Agreement with S30 Studio. Members agree to abide by all rules, regulations, and terms outlined in this document.
Membership Agreement: The contract between the Member and S30 Studio, outlining the terms, conditions, and obligations of the membership.
Minimum Term: The agreed minimum duration of a Membership Agreement, during which Members are obligated to fulfil their payment obligations.
Reciprocal Studio: Any S30 Studio location other than the Member’s Home Studio that offers access as part of a membership plan, where applicable. Not all Studios provide reciprocal access.
Services: The offerings provided to Members, including equipment, classes, personal training, and other benefits based on the membership type selected. Services may differ by Studio.
Suspension: A temporary hold on membership and payments for medical, health, or personal reasons. Suspension requests must be submitted in writing and include supporting documentation, if applicable.
Transfer: The act of moving membership from one Studio to another or from one Member to another, subject to the conditions outlined in this Agreement.
1.2 Unless otherwise required:
(a) References to clauses, sub-clauses, and schedules refer to this document; (b) Words in the singular include the plural and vice versa; gender-neutral terms apply; (c) Headings are for reference only and do not affect interpretation; (d) “Including” means “without limitation”; (e) “You” and “your” refer to the person entering this Agreement.
2. Membership
2.1 Nature of Membership
Membership permits access to S30 Studio facilities, equipment, and services as per the selected membership type. Membership types may include access to group fitness classes, personal training, or 24/7 access, where applicable.
Memberships are non-transferable by Members unless approved by S30 Studio management. Requests for transfers must be made in writing and are subject to an administrative fee.
Membership fees vary by region, based on average operating expenses. S30 Studio reserves the right to adjust membership pricing to reflect these costs, with prior notice provided.
2.2 Studio Privileges
Members in good standing may access any S30 Studio as a Reciprocal Studio, provided the Studio offers reciprocal access, and the Member is not in arrears or in breach of the Agreement. Members must adhere to the policies and rules of each Reciprocal Studio.
Overdue memberships are limited to Home Studio access until arrears are resolved. Access to Reciprocal Studios, where available, may be reinstated upon payment of all outstanding fees.
Complimentary or concession memberships are restricted to Home Studio access and do not include Reciprocal Studio privileges.
2.3 Membership Transfers (Upfront Payments)
Members with upfront payments may transfer to another Studio if both the departing and receiving Studios agree. Transfers are subject to availability and may incur additional fees.
Alternatively, the membership term may be transferred to another person at the same Studio, subject to a $49 transfer fee and approval from S30 Studio management. The receiving Member must agree to all terms outlined in the Membership Agreement.
2.4 Membership Transfers (Direct Debit)
Memberships paid via Direct Debit may be transferred after: (a) A minimum of 3 months at the Home Studio; (b) No arrears on fees or services; (c) Frequent usage of a Reciprocal Studio, where applicable. Transfers are subject to management approval and may result in a change to membership fees based on the new Studio's pricing.
2.5 Foundation Membership
Foundation Membership benefits remain valid if the membership stays at the Home Studio. Members transferring this membership to another Studio will lose their Foundation Membership status and associated benefits.
Transfers to another Studio may result in a fee adjustment to match the standard rate at the new Studio. Members must notify the Studio in writing of their intention to transfer.
3. Privileges
3.1 24/7 Member Access
In the event a Studio has 24/7 access, Members, except those under 16 or with off-peak memberships, may access Studios 24/7 with a key tag. Access is granted only after Members agree to these terms and sign the Membership Agreement.
Access may be revoked for violations, arrears, or abuse. Members must not allow others to use their key tag under any circumstances.
3.2 Unauthorised Guest Access
Members must not allow non-members access during unstaffed hours. Violations may result in: (a) Responsibility for any loss or damage caused by the non-member; (b) A $250 non-compliance fee; (c) Membership termination and prohibition from re-joining any S30 Studio.
3.3 Reciprocal Access
In the event a Studio offers reciprocal access, Members may use Reciprocal Studios for general gym usage, subject to the Member’s membership type.
Additional services (e.g., group classes) may require pre-arrangement, and fees may vary between Studios.
3.4 Additional Services
Memberships include access to standard equipment and facilities. Services such as personal training, nutritional advice, and meal plans may incur additional costs. Members should confirm availability and pricing at their Home Studio.
3.5 Membership Suspension
Suspensions may last up to 6 weeks, requiring a specific end date. Members must submit a written request and meet eligibility criteria.
$10 suspension fee is charged per suspension
Longer suspensions require medical evidence and are subject to approval. Fees may apply unless during a government-mandated shutdown.
Two week’s notice applies for a suspension
3.6 Transferring Membership
Members may transfer memberships to a new person at the Home Studio for a $49 fee. The new Member must agree to all terms of the Membership Agreement.
4. Membership Fees
4.1 Payment Obligation
Members agree to pay fees as outlined in the Membership Agreement via Direct Debit. Payments must be made on time to avoid penalties.
4.2 Dishonour Fees
A $10 administration fee applies for dishonoured payments due to insufficient funds, expired cards, or other issues. Members are responsible for ensuring their payment details are up to date.
4.3 Default Payments
Overdue amounts must be remedied within notification. Persistent defaults may lead to debt collection and additional fees, including a $25 administrative charge.
4.4 Early Cancellation Fee
Cancellation within the Minimum Term incurs a fee 50% of the remaining balance. Members must pay this fee before the cancellation is processed.
4.5 Membership Fee Adjustments
S30 Studio reserves the right to adjust membership fees with 30 days’ notice. Members may opt to cancel within 5 business days of notice, subject to standard cancellation terms.
5. Cancellation
Members must provide written notice of their intention to cancel their membership. Written notice must be submitted via email or letter and will not be accepted through social media platforms or verbal communication.
After the Minimum Term has ended, a 14-day notice period applies. The cancellation will take effect 14 days from the date the written notice is received, and any payments scheduled within this period will be processed as normal.
Members must provide sufficient details, including their full name and reason for cancellation in their written request.
If a Member is within their Minimum Term, they may only cancel under the Early Termination provisions outlined in section 4.4.
6. Legal Compliance
This Agreement adheres to the Australian Consumer Law, the Fair Trading Act 1986 (New Zealand), and relevant laws in Singapore. It also complies with any state, territory, or country-specific fitness industry codes of practice.
Members’ rights are protected under local laws, and these terms do not limit statutory protections.
7. Safety Waiver
I understand that the risk from injury from activity carried out at S30 Studio or any Studio is significant, including permanent paralysis and death, and I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an unsupervised studio at times and assume all risks associated with using exercise equipment in S30 Studio without the aid and supervision of staff members on the premises.
I understand that S30 Studio is a privately owned Studio and HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE STUDIO AND PROPRIETORS, and their respective owners, officers, managers and affiliates, agents and employees (“releasees”) WITH RESPECT TO ANY CLAIM OR DEMAND WHICH MAY ARISE IN RESPECT OF ANY INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE to any person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES or otherwise, that may arise out of or in connection with my use of the equipment or the facilities at the studio premises or any incident that occurs while using the studio’s facilities or engaging in studio activities, or off the studio premises or, otherwise related to my studio membership.
I will keep the Releasees indemnified against all claims, actions, losses and expenses of any nature which the Releasees may suffer or incur or for which the Releasees may become liable in respect of or arising out of:
a) The neglect or careless use or misuse by myself or any guest under my control of the studio facilities or equipment; b) Any accident or damage to property or persons arising from any occurrence in or near the studio’s facilities, wholly or in part by reason of any act of omission by myself or any guest under my control.
I expressly agree that this release is intended to be as broad and inclusive as permitted by the law and if a portion of this release is held invalid, the balance shall remain in full force and effect. I understand that the studio is relying on this release in agreeing to enter into this Agreement.
In addition, I agree to the following conditions:
I will follow and adhere to all rules posted in the studio and as instructed by studio staff.
I will treat the members, staff, equipment and other facilities with respect.
8. Email Communications
By giving your email address to S30 Studio you agree to receive administrative, announcements, newsletters, sales, and marketing emails from S30 Studio. You can opt-out from these emails by clicking on the “unsubscribe” link at the end of the emails.
9. Liability Waiver
I accept responsibility for my use of any and all apparatus, appliance, facility, privilege or service whatsoever, owned and operated at this studio at my own risk, and shall hold this studio, its shareholders, directors, employers, representatives and agents harmless from any and all loss, claim, injury, damage, or liability sustained or incurred by me resulting therefrom.
This document is a legally binding agreement between you and S30 Studio. By signing the Membership Agreement, you confirm that you understand and accept these terms.
